Understanding Your GDPR Obligation

Article 27 of the General Data Protection Regulation (GDPR)  remains a crucial part of your data privacy compliance obligations. In short, if you do business in the EU or UK but don’t have a physical presence in those territories, you may have an obligation under one of these regulations.

For example, if your website uses any analytics, has log files, or stores the IP addresses of European visitors as part of your marketing or eCommerce efforts, you're required to abide by Article 27 of the GDPR. EU and UK authorities have demonstrated that they’re willing to fine even the smallest organizations subject to the GDPR.

Simply put, if your business is located outside of the EU and UK and offers goods and services to EU or UK residents, or collects and monitors information about those residents, you are required to appoint an EU-or UK-based Representative physically located in an EU Member State or the UK.
